Total Separation of Church and State Essay Total Separation of Church and State â€Å"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof†¦Ã¢â‚¬  The first Amendment of the Bill of Rights within the Constitution and an amendment that comes with support, rejection, and controversy. The amendment was made because the forefathers didn’t want a bloodbath that had plagued most of the world. Since 1618, at least 23 million people have been killed during a war revolving around religion issues. The wars have been fought over land, where separate countries claim a spot of land was promised to them, which is similar to the hostility that is going on between Israel and Palestine, and beliefs, like the Taliban and Syrian rebels attacking the United States Embassy’s because of a movie showing the face of the Islamic prophet Allah, and portraying him as a foolish, sexist pig. Many wars were fought â€Å"in the name of God†, which caused many men, women, and children to parish. When the forefathers came to North America, they didn’t want a repeat of the hostility. Thomas Jefferson coined the phrase â€Å"separation of church and state† in a letter to a political friend, and the phrase stuck, with James Madison saying, â€Å"The purpose of separation of church and state is to keep forever from these shores the ceaseless strife that has soaked the soil of Europe for centuries. † Because of the senseless fighting in Europe, separation was widely celebrated. But for separation to work, it needs to be enforced and to be strict. Strict separation is desirable for several reasons. First, it is a way of ensuring that we can all, as Americans, feel that it is â€Å"our† government, whatever our religion or lack of. If government becomes aligned with a particular religion or religions, those of other beliefs are made to feel like outsiders. The total separation of Church and State would benefit all citizens because it would end the persecution of non-religious persons. But, in the end, it comes down to one question: Can anyone prove that religion is a benefit to everyday life if it’s included in government? Since the founding of our country, the United States of America has been, mostly, Christian country with over two-thirds of the people belonging to Christianity, but that number is dropping. With the religious population dwindling down in the United States, the government should erect a wall of separation that James Madison and Thomas Jefferson envisioned. Erwin Chemerinsky wrote in the book Why Church and State Should Be Separate, â€Å"It seem s to me that if we want our citizens to feel that the government is open for everyone – that it is their government – we need our government to be strictly secular. With the total separation of the church from all federal affairs, it would benefit the citizens of the United States of America from persecution on individual’s personal beliefs and ideals. Our forefathers came over to the Americas to escape the religious oppression of the King of England, and the Church. While holding onto their Christian beliefs, the forefathers decided that the land that would become the United States of America would be of religious freedom, so as not to repeat the atrocity of England during this time period. Even though they tried, the oppression found itself on our shores, coming with a vengeance. In the past 50 years, the government has been adding religion into our country. On June 14th, 1954, president Dwight D. Eisenhower signed into law a change to the Pledge of Allegiance by adding ‘Under God’. Two years later, Eisenhower signed a law officially declaring â€Å"In God We Trust† as our nation’s official motto, which also mandated the phrase be printed on all American paper currency. Eisenhower’s choices to add these religious statements showed that the government has ahold of the ideals that once plagued England. This issue has been fought in many unsuccessful lawsuits trying to undo the damage done by Eisenhower. The biggest issue is a government cannot be premised on the belief that all persons are created equal when it asserts that God prefers some. This belief counter acts everything that the country had worked to accomplish. According to the principle of the constitution regarding the separation of church and state, religion is a private matter, which has no place in the presence of government. As in every argument, there are two sides. In this case, people say that we don’t need a wall of separation, that the church and state should become one, and that the United States should officially become a God fearing country, and that anyone who is not a Christian shouldn’t hold political offices. There’s a growing movement in which nonreligious persons are becoming more and more abundant, beginning to compare with the number of the Christians in the country, leading to a conflict that resembles the Crusades without all the violence. All religion should be kept out of government buildings and any and every government acknowledgements of a God should be thrown out, respecting the citizens that are not religious. Throwing out the mention of religion could lead to some major changes within the government, which could benefit the country. The first reason to make this change is that it protects the nonreligious from unfair persecution. Besides the danger of a direct mixture of religion and government, there is an evil which ought to be guarded against in the indefinite accumulation of property from the capacity of holding it in perpetuity by ecclesiastical corporations. Many Americans misunderstand the words â€Å"separation of church and state†, assuming that the law requires that public life must have nothing whatsoever to do with religion. The founders, by and large, were very much supportive of the role of religion in society, but they separated the ideas of society and government, leaving religion to play a role in society, not government. The separation of church and state is not meant to hinder religion, or to deny the role of religion in society or in our history. The concept of â€Å"separation of church and state† applies to the actions of the government only. The second reason to make a change is that we will be able to tax the churches. In 1986, an estimate showed that all religious income for that year was approximately $100 billion, or about five times the income of the five largest corporations in the United States. All tax free. With the money that is made from churches, the country would be bringing in billions of dollars a year that we can use to help pay off the deficit, build more roads, make more jobs, and build more schools. The third reason is that it’ll take the pressure off of public offices. When John F. Kennedy was elected president in 1961, the public was scared that the Catholic Church would take over the country. President Kennedy quickly made public that he supported separation of church and state and that â€Å"no catholic prelate would tell the president (should he be catholic) how to act†¦Ã¢â‚¬  As President Kennedy believed in, the greatest way for our nation to flourish is without religion involved in politics. Many politicians can’t be elected and lose to individuals that are not as qualified as they may have been. Religion is a very powerful tool, which we need to be careful on how we use it. Taking it out of government and federal affairs would greatly benefit the nation. The future of the United States of America is strong and prosperous as long as it adheres to the wishes of the forefathers and past presidents. Without religion, we shall strive. With religion, we will fall. In 1773, a Rev. Isaac Backus, a prominent Baptist minister in New England, studied amongst his people that when â€Å"church and state are separate, the effects are happy, and they do not interfere with each other: but where they have been confounded together, no tongue nor pen can fully describe the mischiefs that have ensued. † Looking at the ministers studies, it comes down to one final question: what will you choose; happy and separate, or mischievous and confounded together? With the non-religious growing in more and more numbers and their beliefs coming out, the world is noticing a change, a change for the better.  The change is bringing down the level of hostility toward non-religious individuals, and with separation of the church and state becoming an even bigger issue in today’s world; it has become a topic which cannot be ignored any longer.

The new realities that businesses have to face are globalization, changing technology, employees from diverse demographic backgrounds, customers, investors and competition from both global and small innovators. Globalization brings in new opportunities and challenges in the form of new markets, exchange rate risks, trade and tariff barriers and distribution challenges. Companies have to compete increasingly with global competitors than local ones. Customers also have more options when selecting a product. The internet has made consumers savvier about the products available in the market. Improvements in the transportation and communication network meant that people were better informed and mobile. A classic example is the fall of the iron curtain where the people learned about the lifestyles of other countries which led to the collapse of the socialist countries. In this environment, Companies need the ability to adapt to the changes that are occurring at lightning speed or as coined by Bill Gates in his book business @ the speed of thought. Therefore organizations need to have the proper leaders who can drive the business towards their strategic goals. The other factors that companies need to address are intense competition, nontraditional management practices and societal consciousness of workers. he role of leadership in business In literature the influence a leader can exercise over followers in an organization is said to be the type of power he or she can exercise. There are five main sources of power; these are reward power, coercive power, legitimate power, referent and expert power. In addition to these five, finlay suggests that personal power and connection power are also factors that need to be considered. (Mullins, 2005). In addition to the above followers also look for trustworthyness, visionary, competancy and inspiring qualities in their leaders. In todays context although being a visionary leader is second only to being trustworthy it is the quality that leaders world over struggle with. In order to be a forward looking individual it is required to first pay attention to the here and now. A leader needs to know what is going on around him in order for him to focus on what needs to be done to get to the objective. It is not always about meeting deadlines it is looking at what comes after the deadline is met or the project is finished that define visionary leadership. Leadership Types A research study undertaken by a consulting firm and reported by Daniel Goleman has identified six types of leadership. Coercive leaders (do what I tell you) Authoritative leaders (Come with me) Affiliative leaders (People Come first) Democratic leaders (What do you think) Pacesetting leaders (Do as I do, Now) Coaching leaders (Try This) The study has also revealed that only four of these styles had a positive effect on employees. The authoritative style was found to be the most effective while the affiliative style. The democratic style and the coaching style were seen as positive. However it was also revealed that effective leaders often use more than one of these styles in various proportions in their dealings. (Mullins, 2005) leaders who have mastered the above four styles and are able to apply them in given situations have ben found to be more effective than others who do not. however it does not mean that the other styles of leadership are not effective when used in the correct situation and context. for example the coearcive style (demands immediate compliance) will work well in a crisis situation. When discussing leadership it is also important to explore the full range leadership model In the above model the bottom left hand quadrant describes avoidant behavior of leadership, which can be further described as non transacting these type of leaders avoid decisions or intervention relying on time to heal all ills. In the middle of the quadrant is transactional leadership, this is goal and result oriented leadership. And at the top right hand corner is the transformational leadership which broaden and elevate interests of followers. In todays organizations with the rapidly changing business environment the leaders we should develop are transformational leaders. The components of a transactional leader are individual consideration, intellectual stimulation, inspirational motivation and idealized behavior. Delving deeper into these components we find that Individual Consideration; values individual needs, shows empathy and encourages continuous improvement. Intellectual stimulation; challenges existing practices, encourages imagination and values intelligence. There is no doubt therefore that all these traits are required from a leader of a organization in this day. Change management Change is often said is the only thing that remains constant in organizations, and change management is defined as the process of achieving the smooth implementation of change by planning and introducing it systematically, taking into account the likely hood of being resisted. (Armstrong, 2009) Most businesses founded during and before the last decade has been steeped in archaic practices that really do not work in the present. Therefore if organizations need to be able to compete in the current business atmosphere companies will need to change the fundamental approaches that they have practiced in the past and embrace new methods of management. Organizations need to first identify why they need to change, the need for change can manifest itself from two directions one is external factors such as economic, social, environmental, technological, legal and political the other is internal factors such as business processers, objectives, technology, finance and structure. In the current context businesses will more often than not be influenced by external factors than internal factors for change. Once this is identified then the organization needs to have a vision of the final destination and the gaps that need to be filled to reach the final objective. It is also important for organizations to plan for this change and most importantly make the stakeholders aware of the importance of this change to the organization in order to get their buy in. Herbert C Kelman explains in his paper on attitude change that there can be three processes of influence. Compliance Occurs when an individual accept influence because of a reward or punishment by conforming. Thus the satisfactions derived from compliance are due to a social effect of accepting influence. Identification This is said to occur when an individual accepts influence because he wants to establish or maintain a satisfying self defining relationship with another person or group. Internalization This occurs when an individual accepts influence because it is intrinsically rewarding, he adopts the behavior because it is congruent with his values. (Kelman, 1958) Therfore in an organisation which is going through change all the above three types may be encountered, there will be some who comply because of the rewards or punishment some who will comply with change due to their relaqtionship with other members of the organisation and others who find that the change conforms to their values. Resistance to change People resist changing whenever they feel that the change is a threat to them. Resistance can take many forms; it can be active, passive, covert, overt, aggressive, timid, individual or organized. The top ten reasons for resisting change as argued by A. J. Schuler, Psy. D (A. J. Schuler, 2003) The risk of change is seen as greater than the risk of standing still People feel connected to other people who are identified with the old way People have no role models for the new activity People fear they lack the competence to change People feel overloaded and overwhelmed People have a healthy skepticism and want to be sure new ideas are sound People fear hidden agendas among would-be reformers People feel the proposed change threatens their notions of themselves People anticipate a loss of status or quality of life People genuinely believe that the proposed change is a bad idea. Dealing with resistance In order to overcome resistance to change a few methods can be used, foremost is to guarantee the employees security, thereafter a good communication plan of the objectives of the change should be instituted. Concerns of employees should be discussed and understood by the management. Where possible the most vociferous resistors should be made participants of the change management team. Flexibility should be made a key word in the change process. Incentives such as rewards can also be used to change the mind set of employees. In implementing the change an incremental change model can be used where initially small changes are done and once the employees have been removed from their comfort zones a bigger and more radical change is made. There can be several iterations of this with small periods of inactivity to allow the changes to normalize. This approach will make the change more acceptable as employees will be able to experience the benefits of each change prior to proceeding to the next iteration. Group behavior In organizations you will find several individuals forming groups to achieve common objectives, these groups or teams can exist as formal or informal groups. When formed as a formal group they will be part of the structure of the organization. In order to appreciate how groups behave we need to consider the nature of the following. (Armstrong, 2009) formal groups; informal groups; the processes that take place within groups; group ideology; group cohesion; group dynamics; The concept of a reference group and its impact on group members; The factors that make for group effectiveness. Formal Groups Organizations set up formal groups in order to achieve a defined purpose. The composition, size and structure of the group will depend on the nature of the task; if the task is clearly defined the leader may exercise authoritative power which if the task is routine in nature then the leader will exercise a more supportive role in this case the team will operate in democratic manner. Informal groups Individuals who have likeness towards each other can set up Informal groups, these can be in the form of book clubs, social club etc. A study conducted by Roethlibeger and Dickson in 1939 has revealed that activities within groups could be regulated by their own conduct and output irrespective of what the administration wanted, however by understanding the processes that take place within groups can help them work for the organization rather that against it. The processes that take place within a group. The manner in which groups function are affected by the size of the group and the task at hand, although there can be a greater knowledge base in a large group, individuals in the group may find it difficult to contribute. The main processes that take place in groups are interaction, task and maintenance functions, group ideology, group cohesion, group development and identification. (Armstrong, 2009) Reference groups A reference group comprises of a group of people with whom an individual identifies with .Most individuals in an organizations belong to a reference group and this can considerably affect the ways in which they behave. Initially a group member may comply in order to be accepted as part of the group, however as time progresses the norm will get internalized and the individual will react in the same manner whether in the group or not. Influencing groups Vince Lombardi arguably the greatest NFL football coach once said true leadership involves not only the ability to direct people, but the ability to have them embrace your direction influencing or persuading people to embrace your direction is a multi step process. In order for you to be able to persuade the first thing you need is credibility or trust and be perceived to be a person who keeps his word. The second is to canvass, which is to have a series of exchanges with individuals and groups to obtain a clear view of the concerns, goals and aspirations. The third is to try your ideas on opinion leaders, discuss your ideas with small groups get their feedback and importantly try to get the opinion leaders acceptance of the ideas. Then use the information gathered and reframe the idea in a manner which they see it as their own. By adopting the approaches discussed in this chapter an organization can obtain the support it needs to change and overcome any resistance by employees to the proposed changes. Training and Development Donald Schon argues that the loss of stable state in our society and its institutions means that they are in a process of continuous transformation and that we cannot expect new stable states that will endure for our own lifetimes. Therefore we must become adept at learning. (Smith, 2009) In order for an organization to able to be competitive in its business space it first needs to understand the skills it needs. Thereafter a gap analysis should be carried out to identify what skills are required In order for the company to reach its goals. All employees want their services to be valuable to their employers and be able to be competitive in the employment market. And the only method of achieving these targets is training and development. It is also a motivating factor for the employee since by being trained on the skills he needs to perform his function he becomes more comfortable and adept at his task. Employers should strive to build in training into their evaluation of the employee so that the final measurement of his performance will be realistic and aligned towards to companies goals and objectives. Conclusion In conclusion, an organization of today need a multifaceted approach to shape its organizational behavior. Foremost among them is the need to be able to adapt quickly to change. To do this the organization needs to have visionary leaders who will be able to manage the changes happening around them in ways that keep the motivation of the employees at high levels while maintaining the momentum of the organization. They also need also to focus on other aspects such as environmental, cultural and political issues in order to survive in todays business environment. Donald Sull a professor of management practice at the London school of business has to say this companies that execute on their strategies quickly and effectively tend to construct solid organizational hardware: information systems, corporate priorities, incentives and so forth. But they also program in software That is the right culture, people and leadership for execution. The most agile organizations share a core set of va lues: achievement that recognizes and rewards employees for setting and achieving ambitious goals, ownership, team work, creativity and integrity. Why the court should have the right to impose a publication ban in Cana

Publication bans have been a part of the Criminal Code since 1988. A publication ban is a court law that prohibits trial information from leaving the case. Since these bans were first introduced in Canada, they have become a very useful tool in Common Law. These bans have been frequently used over the years for many purposes including avoiding the risk of adverse consequences to participants and for more accurate trial procedures. Having publication bans are beneficial, in every which-way, than not. These bans contribute positively to the environment of law and most importantly, the society within. This essay will outline why the court should have the right to impose a publication ban in Canada. It will support the debate that if Canada wishes to build towards a reputation of having trials handled efficiently, then it should not change the nature of these publication bans. It will portray the importance of these bans through a thorough explanation of how the bans work, and two solid arguments of the cause on the society and environment. First, this essay will discuss basics of publication bans and how they work. Then, this essay will point out how publication bans contribute to trial fairness in the court. Finally, this essay will touch upon how publication bans protect victims and those involved in the trials. The court, when needed, handles publication bans wisely and with care. Cold War Impact on US Foriegn Policy

The mentality of the Cold War greatly affected the decisions made by the Presidents that held the office from 1950 to 1974. The main thought that prevailed from the beginning of the Cold War was containment. It was the main goal of the United States to contain the spread of Communism whenever possible. â€Å"Brinkmanship† was the first major policy that was employed by the United States in the effort to stop the spread of Communism throughout the world. President Eisenhower’s Secretary of State John Foster Dulles coined the term â€Å"Brinkmanship†, which simply stated means using the military to push things to the brink of war without actually going to war. This was often used to intimidate the Soviet Union into backing down during the early part of the Cold War era. President Kennedy would take a slightly more flexible stance in terms of retaliation should an attack occur. However, it wouldn’t be until President Nixon took office that the metaphorical waters between the US and the Soviet Union would begin to calm.Could Cold War Have Been Avoided? In 1957 Secretary of State John Foster Dulles addressed the Associated Press in a speech known as Dynamic Peace. In this speech Secretary Dulles seems to be trying to convince the American public why they must always be prepared to go to war even though it was not what America desired. He also explained how the Soviet Union would not want the free nations of the world to work together to arm themselves and be willing to protect each other from attack. The Soviet rulers understandably prefer that the free nations should be weak and divided, as when the men in the Kremlin stole, one by one, the independence of a dozen nations. So, at each enlargement of the area of collective defense, the Soviet rulers pour out abuse against so-called â€Å"militaristic groupings. † And as the free nations move to strengthen their common defense, the Soviet rulers emit threats. But we can, I think, be confident that such Soviet assaults will not disintegrate the free world. Collective measures are here to stay. . . .† Dulles goes on to talk about how the greatest deterrent of war is the retaliatory ability of other nations. Secretary Dulles then goes on to explain that the United States sought the liberation of the nations under the Soviet Union not to surround Russia with hostile nations but because peace cannot be achieved until all captive nations are set free. President John F. Kennedy would set the tone of his administration’s stance on the Cold War and the Soviet Union during his inaugural address. He asked that the nations of the world to come together to fight â€Å"the common enemies of man: tyranny, poverty, disease, and war itself†. His address gave realistic expectations by saying that his goals might not even be achieved during his generation’s lifetime, but even that possible truth should not discourage the United States or the rest of the world from starting on the road towards peace and freedom for the whole world. In June 1961 President Kennedy met with the Premier of the Soviet Union Nikita Khrushchev. During this meeting many subjects were discussed, but the most important was Berlin. Even though he allowed himself to be bullied, President Kennedy felt he made it clear to Khrushchev that the United States was not willing to compromise on a withdrawal from Berlin. Only a few short months later East German authorities would begin to restrict the movements of people from East Berlin into West Berlin. These actions would prompt the United States to send a note to the Soviet Union protesting these actions and asking that the Soviet Union put a stop to it before things got too far out of hand. The Soviet Union’s reply stated that it supported the actions of the East German Government because they were trying to protect themselves from western spies who were trying to undermine the Government. It goes on to talk about how the United States is well aware of these activities and is just trying to shift blame so that the illegal activities of the West could continue. â€Å"West Berlin has been transformed into a center of subversive activity diversion, and espionage, into a center of political and economic provocations against the G. D. R. , the Soviet Union, and other socialist countries. Former and present West Berlin municipal leaders have cynically called West Berlin an ‘arrow in the living body of the German Democratic Republic,’ a ‘front city,’ a ‘violator of tranquility,’ the ‘cheapest atom bomb put in the center of a socialist state. ’† All of the back and forth between the United States and the Soviet Union would come to a head a little more than a year later with the Cuban Missile Crisis. When the United States government discovered that the Soviet Union was building bases meant to house ballistic missiles President Kennedy had a choice. He could have very easily used the occasion as justification for an attack on the Soviet Union. But instead he made the choice that kept the world from World War III. Instead of attacking the Soviet Union President Kennedy, on October 22, 1962, addressed the nation and the world and announced that there would be a blockade on Cuba. This blockade would only turn away ships carrying weapons and not stop ships carrying the necessities that the people of Cuba would need. â€Å"We are not at this time, however, denying the necessities of life as the Soviets attempted to do in their Berlin blockade of 1948. On October 28, 1962 the confrontation ended with the Soviet Union agreeing to dismantle their offensive weapons in Cuba. As time continued to go by both the United States and the Soviet Union were in positions where a relaxation of the tensions between them was necessary. Soviet leadership felt that the financial costs of the nuclear arms race were unsustainable. The United States was spending millions on the war in Vietnam and trying to extend the welfare state in the country. The Soviet Union was experiencing troubles in their relationships with China, and they worried that these troubles might lead to an American-Chinese alliance. â€Å"All this is, in the first place, a stab in the back for the heroic Vietnamese people in their struggle against the American aggressors, Imperialist circles fully approve of this line of Mao Tse-tung's group. The Washington Post has said that officials in Washington believe that Mao is serving American interests and they are therefore even thinking of cultivating Maoism as a means of bringing pressure to bear on Moscow. The magazine United States News and World Report has directly stated in this connection that the United States is gambling oil Mao and that American officials tend to prefer a victory for Mao Tse-tung in his struggle to destroy more nioderate elements, because that would mean more trouble for Soviet Russia. † During President Richard Nixon’s administration the first steps towards Detente began. The most important part of this was the SALT I treaty of 1972. The conditions of Detente allowed for mutual cooperation between the United States and the Soviet Union. In fact one of the basic principles of relations between the Soviet Union and the United States was that the two nations work together especially in the areas of science and technology. In July of 1975 the United States and the USSR would work together on the Apollo-Soyuz project. Even though the idea of containment was the driving force behind many of the decisions made by US presidents during the Cold War, each President had their own ideas on how best to achieve that containment. For President Eisenhower the best strategy was â€Å"Brinkmanship†, while President Kennedy took a slightly more flexible approach. Had Kennedy followed the lines of â€Å"Brinkmanship† the Cuban Missile Crisis would most likely have been the start of World War III. President Nixon, due to the changing world and economic climate was able to reach at least some neutral ground with the Soviet Union. The relaxation of tensions in the late 1960s and early 1970s helped to bring about the end of the Cold War in the early 1990s.
